aTx Trusted Advisory

Agreement
By accessing or using aTx Trusted Advisory (the “Service”), you agree to these Terms. In these Terms, “Software” means the Service and all xChat conversations, strategy recommendations, portfolio analysis tools, options models, and any other content or outputs made available through the Service. If you do not agree, you may not use the Service.
The Service
aTx Trusted Advisory is a software platform that provides tools to help high-net-worth families and their advisors consolidate, track, analyze, and report on portfolios. This includes dashboards, reporting, collaboration features, and AI-assisted chat.
Important Regulatory Disclaimers
Educational and Informational Purposes Only
The Software is provided strictly for educational and informational purposes. It is not intended to provide, and does not constitute, personalized investment, financial, tax, legal, or other professional advice. Nothing contained in the Software is a recommendation to buy, sell, or hold any security or to pursue any particular investment strategy.
No Advisory Relationship
Your use of the Software does not create an investment advisory, fiduciary, or other advisory relationship between you (or your clients, if you are an Investment Adviser) and ATX Finance Advisory, its affiliates, or any of its personnel. ATX Finance Advisory is not acting as your investment adviser, and you are solely responsible for determining the suitability of any investment or strategy for your own (or your clients’) specific financial situation, objectives, risk tolerance, and needs. You should consult with a qualified investment adviser, attorney, or tax professional before making any investment decision.
No Performance Guarantees
Past performance is not indicative of future results. All hypothetical illustrations, back-tested data, options strategy models, and projected outcomes are for illustrative purposes only and do not guarantee actual results. Market conditions, liquidity, transaction costs, taxes, and other factors can materially affect real-world performance.
Data and AI Limitations
The Software uses artificial intelligence and third-party data sources. While we strive for accuracy, ATX Finance Advisory makes no representations or warranties regarding the completeness, accuracy, timeliness, or reliability of any data, analysis, or output. AI-generated content may contain errors, omissions, or biases.
Regulatory Status
ATX Finance Advisory and its personnel are not currently registered as investment advisers with the U.S. Securities and Exchange Commission or any state securities regulator. The Software is not offered as a registered advisory service.
User Responsibility
You agree that you (and any clients you serve) are solely responsible for all investment decisions, trading activity, and compliance with applicable securities laws. You will not rely on the Software as the primary or sole basis for any investment decision.
License Restriction
You may use the Software only for your internal educational or informational purposes. You may not re-sell, re-distribute, or otherwise make the Software available to third parties except as expressly permitted in this Agreement.
Eligibility
You must be at least 18 years old and have the authority to enter into this agreement. You are responsible for keeping your account credentials secure and for all activity under your account.
Acceptable Use
You agree not to misuse the Service, including:
- Violating any laws or third-party rights
- Attempting to hack, probe, or overload the Service
- Reverse engineering or copying the Service (except as permitted by law)
- Transmitting malware, spam, or unlawful content
Third-Party Services
The Service uses third-party data sources, APIs, and AI models. We are not responsible for their availability, accuracy, or terms.
Intellectual Property & License
We (and our licensors) own all rights to the Software. We grant you a limited, non-exclusive, non-transferable license to use the Software solely for your internal educational or informational purposes, including portfolio management and reporting workflows permitted under these Terms and your account role. The License Restriction above applies to this grant.
You retain ownership of the data you upload, but you give us permission to host, process, and display it as needed to provide the Service.
Disclaimer of Warranties
The Service is provided “AS IS” and “AS AVAILABLE” without any warranties, express or implied.
Limitation of Liability
To the fullest extent permitted by law, ATX Finance Advisory, aTx Trusted Advisory, and their suppliers will not be liable for any indirect, incidental, special, or consequential damages.
Our total liability to you will not exceed the greater of (a) the total amount you paid for the Service in the twelve months before the claim arose, or (b) one thousand U.S. dollars (US $1,000).
Indemnity
You agree to indemnify and defend us against any claims, losses, or damages arising from your use of the Service, your content, or your violation of these Terms.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or for security/legal reasons.
Governing Law
These Terms are governed by the laws of the State of Texas. Any disputes will be resolved in the courts located in Travis County, Texas.
Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after the changes take effect means you accept the new Terms.
